Logan said outside counsel Tasha Jones met individually with each commissioner the Monday before the meeting, with City Attorney Rebecca Doctor and Clerk of Commission D. Clayborne also present — meaning eight people in total were privy to the privileged discussion about the city's legal strategy on Montana Attorney General Knudson's investigation into Resolution 21-1062. Logan said that at the following Wednesday's administrative meeting, public commenters demonstrated knowledge of that confidential information, calling it 'a serious matter that undermines the city of Helena and its ability to legally defend itself.'

Mayor Dean corroborated Logan's concern, saying she received phone calls before the Wednesday meeting from community members who relayed what appeared to be privileged litigation strategy. She warned that when attorney-client communications become public, it 'weakens the city's ability to defend ourselves successfully in litigation,' particularly when facing larger entities. Dean suggested the commission may need to revisit its governing bylaws.

No formal action was taken at the March 23 meeting, and the identity of whoever allegedly shared the information was not established. The allegation is particularly consequential because the city is currently under active investigation by the Attorney General, with a special meeting on the matter scheduled for March 26.
