The two liens, both recorded June 4 in Lewis and Clark County, name Simkins Lumber Co. as the claimant against Mountain View Meadows LLC. One covers multiple lots in the Peaks Phase 1 portion of Crossroads at Mountain View Meadows; the other targets a commercial parcel in the Commercial 4 section of the same development. A right-to-claim lien is a preliminary step in Montana's construction lien process, typically filed by a material supplier or subcontractor to preserve their right to collect payment for goods or services provided to a project.

One day after the liens were recorded, Mountain View Meadows transferred a home in Craftsman Village Phase 8 — also part of the Crossroads at Mountain View Meadows development — to Kenneth J. and Bobbi R. Palagi. The deed was recorded June 5 in Book M65, Page 4621. County records suggest the Palagis may be based outside Montana, making it an out-of-area purchase in a subdivision that has generated at least eight filings across deed, capital flow, and lien records.

Taken together, the filings show a developer actively selling finished homes in one phase of a large subdivision while facing unresolved materials claims in other phases of the same project. That pattern isn't unusual in large phased developments, where construction on later phases continues after early homes are sold — but the back-to-back timing this week puts the financial threads in plain view in the public record.

Simkins Lumber, a regional building materials supplier, has not filed a formal lien yet; a right-to-claim is a notice of intent, and Montana law gives the claimant time to pursue the full lien if payment isn't received. Whether the claims are resolved before Mountain View Meadows records additional deed transfers in the Peaks or Commercial sections remains to be seen. Residents buying into the development would want to confirm clear title before closing.
